CANON EXCHANGE OFFER” PROGRAM TERMS AND CONDITIONS

These terms and conditions are applicable for the “Canon Exchange Offer” program (hereinafter called the “Program”) organized by Canon India Private Limited (“CIPL”).

By participating in this Program, it will be deemed that the customer(s) participating in the Program have understood and accepted the terms and conditions of the Program.

This Program is valid only in India and in selected cities mentioned in “Annexure A” herein. The details of the nominated the Canon Authorized Resellers (CAR) nominated by the Canon Premium Partner (CPP) is mentioned in “Annexure B” herein.

Your participation in the Program is open to the public in select outlets of the CAR and subject to acceptance of these Program terms and conditions, terms of use of Website https://edge.canon.co.in/t-n-c and Canon India’s privacy policy published https://edge.canon.co.in/privacy-policy on the Website.

Program Details:

a) “Customer(s)” shall mean an end-user (a person, firm, company or the legal entity) which has received invitation to participate in the Program or who have voluntarily visited the participating CAR outlets and expressed interest in the Program during the Program Period.

b) The Program is effective from 15th November, 2022 (12:00AM) till 31st December, 2022 (11:59 PM) (”Program Period”)

c) The Program is valid only on the sale of Canon brand printers bearing Model Nos. Pixma G570 & Pixma G670 to the end Customer only (“Product(s)”) which are imported, marketed and sold by CIPL.

d) This Program is not valid for purchase of Product(s) by distributors, retailers, resellers, and institutional buyers.

e) Program Process Flow:

STEP 1:

CIPL’s authorized Call Center representatives (Call Center) shall contact the proposed Customer(s) to check their interest in availing benefits under the Program.
If the Customer(s) express interest in availing the benefits under the Program, then the Call Center shall schedule an appointment for providing an on-site Product demonstration by the Vendor’s representatives.
Upon completion of demo if the Customer(s) express interest in availing “Canon Exchange Offer” then the representative of the Vendor shall register the Customer mobile number on https://edge.canon.co.in/unboxdelight and a discount coupon shall be electronically generated by using One-Time Password (OTP) verification process.

OR

STEP 1a:

Any Customer interested in availing the benefits under the Program may directly visit the outlet of participating CAR to register for the Program.
CAR shall register the mobile number of such Customer on https://edge.canon.co.in/unboxdelight to schedule an appointment for providing an on-site Product demonstration by the Vendor’s representatives.
Upon completion of demo if the Customer(s) express interest in availing “Canon Exchange Offer” then the Vendor representative shall register the Customer mobile number on https://edge.canon.co.in/unboxdelight and a discount coupon shall be electronically generated by using One-Time Password (OTP) verification process.

STEP 2:

The end Customer(s) is required to buy a Product(s) during the Program Period from the CAR and at the time of purchase Customer shall provide the coupon code to the CAR and handover his/her old printer, in working/ non-working condition to the CAR ("Old Printer”) in exchange to avail the discount as per the Program.

STEP 3:

The CAR shall collect the Old Printer from the end customer and provide a discount of Rs. 1999/- (inclusive of GST) to the end customer upon purchase of the Product during the Program Period.

GENERAL TERMS

CIPL shall get the said Old Printer(s), which are exchanged & collected under this Program, collected through its authorized E-Waste recycler from the CPP and get the collected Old Printers recycled in an environment friendly way.

CIPL shall not be responsible for system outages, delays, malfunctions, errors or data loss of any kind, lost or unavailable connections, or failed, incomplete, garbled or deleted transmissions or other technological difficulties or any other force majeure event that may prevent the Customer(s) from availing the discount offered in the Program at the time of generation of discount coupon or the OTP. Further, CIPL will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or content; (c) any computer or communications related malfunctions or failures; or (d) any disruptions, losses or damages caused by events beyond the control of CIPL.

CIPL shall not be responsible or liable to the Customer(s) in any manner (i) for any error, wrong or incorrect entry by the CPP /CAR, (ii) if the sale of the Product by the CPP /CAR is not made due to supply shortage or issues which are beyond the reasonable control of CIPL.

Any tax liability related to the discount offered by CIPL under the Program will have to borne by the CPP /CAR.

This Program cannot be grouped together with any other existing offer of CIPL or any other offer that CIPL may launch during the Program Period.

CIPL will collect personal information during registration process for the purpose of hosting and management of the Program. CIPL may however disclose such information received from the Customer(s) to any third-party vendor, and logistics vendor solely for the purpose of this Program and/or to any government authority, agency, and regulatory/statutory body as may be required by law. Further, CIPL shall treat your personal information in accordance with CIPL's protocols, applicable laws and regulations and CIPL's latest privacy policy published in its corporate website https://in.canon/en/consumer/web/privacy.

CIPL shall not be liable to the Customer(s) in any manner for any act or omission of the CPP /CAR which is in contravention of the terms and conditions of this Program.

The Customer(s) shall indemnify, defend and hold harmless CIPL its officers, directors, employees, agents, shareholders and representatives, parent and Group Companies ("Indemnified Parties") at all times, from and against any and all claims including third party claims, action, damage, demands, loss (including loss of profit pursuant to a breach of these terms and conditions by the Customer(s)), liability, cost including legal fees and expense, or deficiencies suffered or may be suffered, paid or may be paid, directly or indirectly by the Indemnified Party, as a result of, in connection with or arising out of any breach of the representations and warranties made by the Customer(s) herein, any breach of the terms and conditions of these terms and conditions or violation of the Law, by the Customer(s).

CIPL reserves the right to modify or cancel this Program at any time without any prior notice to Customer(s).

This Program is subject to force majeure conditions that are beyond the control of CIPL and CIPL shall not be responsible or liable for any consequences arising out of any force majeure events/occurrences.

Suspected or actual fraud and/or suspected or actual abuse relating to the Program may result in immediate cancellation of the registration and the Customer’s participation in the Program, in addition to any other rights or remedies available to CIPL whether in law or equity.

If any terms and condition of the Program found to be unlawful, void or for any reason unenforceable, that provision will be deemed severable from these terms and conditions and will not affect the validity and enforceability of any remaining provision, unless it is practically not possible to administer the Program.

These terms and conditions and the Program shall be governed by laws of India and only the courts at New Delhi shall have the exclusive jurisdiction in respect of any disputes, controversies and conflicts with relation to the Program.
